Original title: &#8220;A prop\u00f3sito de la declaratoria de inconstitucionalidad por parte de la Corte Suprema de Justicia de Panam\u00e1 de una ley-contrato minero&#8221; (Regarding the declaration of unconstitutionality by the Supreme Court of Justice of Panama of a mining contract law).<\/em><\/p>\n\n<hr class=\"wp-block-separator has-text-color has-alpha-channel-opacity has-background is-style-dots\" style=\"background-color:#004f5e;color:#004f5e\"\/>\n\n<p><\/p>\n\n<p>On November 27, the Panamanian Supreme Court of Justice declared unconstitutional the law adopted by the Panamanian Legislative Branch approving a contract granting a Canadian mining company copper exploration and exploitation rights in Panamanian territory (see BBC <strong><a href=\"https:\/\/www.bbc.com\/mundo\/articles\/cg6pgpewkyno\">article<\/a><\/strong> and <strong><a href=\"https:\/\/elpais.com\/america\/2023-11-28\/la-corte-suprema-declara-inconstitucional-el-contrato-minero-que-provoco-masivas-protestas-en-panama.html\">article<\/a><\/strong> by ElPa\u00eds, Spain).<\/p>\n\n<p>The case goes back to a previous mining concession granted in 1997, and already declared unconstitutional by the same Panamanian justice in a judgment of December 21, 2017: see the opinion <a href=\"https:\/\/cdn.corprensa.com\/la-prensa\/uploads\/2023\/11\/06\/Respuesta%20del%20Procurador%20al%20MICI.pdf\"><strong>text<\/strong><\/a> of the Panama Administration Attorney&#8217;s Office of May 2021, and the <strong><a href=\"https:\/\/www.gacetaoficial.gob.pa\/pdfTemp\/29685_D\/GacetaNo_29685d_20221219.pdf\">text<\/a><\/strong> of the decree of December 19, 2022 adopted by the Panamanian environmental authorities. <\/p>\n\n<p>Since 2014, a report on the negative impact of Canadian mining companies in Latin America has been waiting for Canadian authorities to take action to regulate their activities from Canada, particularly from the perspective of human rights and environmental protection (<strong>Note 1<\/strong>).<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"400\" height=\"225\" src=\"https:\/\/www.sensorialsunsets.com\/wp-content\/uploads\/2023\/12\/Nicolas-Boeglin-Sensorial-Sunsets.png\" alt=\"We share the text written by Professor Nicol&#xE1;s Boeglin, from the Law School of the University of Costa Rica on the mining contract law in Panama.\" class=\"wp-image-12906\" style=\"width:596px;height:auto\" srcset=\"https:\/\/www.sensorialsunsets.com\/wp-content\/uploads\/2023\/12\/Nicolas-Boeglin-Sensorial-Sunsets.png 400w, https:\/\/www.sensorialsunsets.com\/wp-content\/uploads\/2023\/12\/Nicolas-Boeglin-Sensorial-Sunsets-300x169.png 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><figcaption class=\"wp-element-caption\">Photo extracted from <a href=\"https:\/\/elpais.com\/america-futura\/2023-10-27\/protestas-masivas-en-panama-en-rechazo-a-una-concesion-para-explotar-la-mayor-mina-de-cobre-de-centroamerica.html\">press article<\/a> (El Pa\u00eds, Spain) titled &#8220;<em>Protestas masivas en Panam\u00e1 en rechazo a una concesi\u00f3n para explotar la mayor mina de cobre de Centroam\u00e9rica<\/em>&#8221; (Massive protests in Panama in rejection of a concession to exploit the largest copper mine in Central America), edition of 10\/26\/2023.<\/figcaption><\/figure>\n<\/div>\n<h3 class=\"wp-block-heading\">The verdict of November 27, 2023 in (very) brief<\/h3>\n\n<p>In a long sentence (see <a href=\"https:\/\/cdn.corprensa.com\/la-prensa\/uploads\/2023\/11\/28\/fallo_27nov2023_corte_suprema.pdf\"><strong>full text<\/strong><\/a>), the nine members of the Supreme Court unanimously declared the law approved in October 2023 unconstitutional. <\/p>\n\n<p>The magistrates indicate that the Panamanian State must establish priorities, which its authorities apparently ignore, when they emphatically point out (p. 111):<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-black-color has-text-color has-link-color wp-elements-a94ff99b18915e0b2fcb512dd85031c2\"><em>Por lo que, en esa l\u00ednea de pensamiento, mal podr\u00eda el Estado sobreponer los intereses econ\u00f3micos frente a la protecci\u00f3n de derechos humanos. En ese tenor, si bien la Rep\u00fablica de Panam\u00e1, se ha constituido en parte del Tratado de Libre Comercio y del Tratado Bilateral de Inversi\u00f3n con el Estado Canadiense, al generarse la colisi\u00f3n de derechos econ\u00f3micos frente a derechos que se vinculan a la protecci\u00f3n del derecho a la salud y a la vida, el Estado necesariamente deber\u00e1 priorizar \u00e9stos \u00faltimos<\/em>.<\/p>\n<\/blockquote>\n\n<p>In this same judgment, in addition to the two international economic instruments referred to by the judges in the previous quote, other international treaties to which Panama is a State Party in environmental matters are also included, in particular one of them: the Escaz\u00fa Agreement, adopted in Costa Rica in March 2018 and which to date has 15 States Parties, among which Costa Rica is not included (<strong>Note 2<\/strong>). <\/p>\n\n<p>More precisely, we read that (p. 180):<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-black-color has-text-color has-link-color wp-elements-7e0bc7a7875eaca82e76d04c14d1fa76\"><em>Lo anterior, debe verse en concordancia con lo dispuesto por el Acuerdo Regional sobre el Acceso a la Informaci\u00f3n, la Participaci\u00f3n P\u00fablica y el Acceso a la Justicia en Asuntos Ambientales en Am\u00e9rica Latina y el Caribe (Acuerdo de Escaz\u00fa), aprobado por la Rep\u00fablica de Panam\u00e1, mediante Ley No 125 de 4 de febrero de 2020, y que dispone en su art\u00edculo s\u00e9ptimo la garant\u00eda de propiciar la participaci\u00f3n ciudadana en asuntos ambientales de entidad, como lo es por ejemplo, el proyecto de miner\u00eda que en esta ocasi\u00f3n fue elevado a Contrato Ley. Por ser signatarios del referido acuerdo, y en acatamiento del art\u00edculo 4, concordante con el art\u00edculo 17, ambos de la Constituci\u00f3n Pol\u00edtica, el Estado adquiri\u00f3 obligaciones internacionales, de \u00edndole social y ambiental, con la finalidad de asegurar a la ciudadan\u00eda, la efectividad del derecho al acceso de la informaci\u00f3n, sobre aquellos asuntos que puedan afectar el libre disfrute de su derecho a un medio ambiente sano, como derechos fundamentales, y dada su incidencia en la dignidad de las personas<\/em>. <\/p>\n<\/blockquote>\n\n<p>The Panamanian magistrates also indicate (pp. 181-182) that:<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-black-color has-text-color has-link-color wp-elements-7f340b7a7c89bd97743ef4190ae6d0e7\"><em>Es decir que, al tiempo en que se dieron las discusiones legislativas, que concluyeron con la aprobaci\u00f3n del Contrato Ley No406 de 20 de octubre de 2023, exist\u00edan pautas normativas, dentro de la legislaci\u00f3n paname\u00f1a, que\u00a0contemplaban mecanismos efectivos para poner en conocimiento de los habitantes de las comunidades aleda\u00f1as; y de la poblaci\u00f3n en general, toda la informaci\u00f3n relacionada con las consecuencias y efectos de la actividad minera que se realiz\u00f3, que se encontraban realizando, y que se iba a realizar, en virtud del Contrato Ley. No obstante, lo verificable es que la concesi\u00f3n minera fue aprobada sobre la base de un informe de impacto ambiental; el cual, adem\u00e1s de no ser reciente, y por ende, no contener informaci\u00f3n actualizada sobre la situaci\u00f3n ecol\u00f3gica vigente al momento de su celebraci\u00f3n, omite cumplir la normativa reglamentaria emitida por el Estado, con el objetivo de brindar efectividad al derecho de acceso a la informaci\u00f3n, en materia de asuntos ambientales, suscrito a trav\u00e9s del Acuerdo Regional sobre el Acceso a la Informaci\u00f3n, la Participaci\u00f3n P\u00fablica y el Acceso a la Justicia en Asuntos Ambientales en Am\u00e9rica Latina y el Caribe (Acuerdo de Escaz\u00fa)<\/em>.<\/p>\n<\/blockquote>\n\n<p>As can be seen, the speed with which the approval of this law was processed completely ignored one of the most basic principles of contemporary environmental law, which is included in Panamanian environmental legislation itself: the principle of citizen participation in environmental matters.<\/p>\n\n<h3 class=\"wp-block-heading\">Mining companies and political authorities: a strange feeling of &#8220;d\u00e9j\u00e0 vu&#8221;<\/h3>\n\n<p>This ruling puts an end to more than a month of protests and demonstrations by various sectors of Panamanian society, who took to the streets from their homes to protest the peculiar way in which this controversial law was passed: it was an &#8220;<em>express<\/em>&#8221; approval on Friday, October 20, 2023 and whose authors possibly intended it to pass almost unnoticed (see <a href=\"https:\/\/semanariouniversidad.com\/mundo\/congreso-panameno-aprueba-contrato-con-mina-canadiense-en-medio-de-protestas\/\"><strong>note<\/strong><\/a> from <em>Semanario Universidad<\/em> of the same October 20, specifying that the vote was 44 in favor, 5 against and 2 abstentions).<\/p>\n\n<p>To the aforementioned expeditious procedure, we must add the profound indignation of the Panamanian population at the (no less peculiar) attitude of the highest Panamanian authorities in defending this mining project against all odds: a strange sensation of company-authorities unison that we may qualify as &#8220;shameless symbiosis&#8221; in relation to a questioned mining project of a Canadian mining company in Costa Rica (<strong>Note 3<\/strong>).<\/p>\n\n<h3 class=\"wp-block-heading has-white-color has-text-color has-link-color wp-elements-7c73fec409a405a7a6acbf279721d330\">Mining contract law Panama<\/h3>\n\n<p>In the text of the aforementioned ruling of the Supreme Court of Justice of Panama, the deep annoyance of its magistrates with the manner in which this mining contract was negotiated is evident, reading in particular that (p. 171):<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>Constituye una afrenta a la separaci\u00f3n de poderes que, ante una declaratoria de inconstitucionalidad de esta M\u00e1xima Corporaci\u00f3n de Justicia, se haya negociado un contrato de concesi\u00f3n incurriendo en los mismos yerros; y llama la atenci\u00f3n el hecho que en el nuevo contrato convertido en Ley No 406 de 20 de octubre de 2023, incluso se mencione el contrato anterior, como si la Sentencia de Inconstitucionalidad no hubiese sido dictada<\/em>.<\/p>\n<\/blockquote>\n\n<p>The &#8220;<em>express<\/em>&#8221; processing of a law observed in Panama is reminiscent of another &#8220;<em>accelerated<\/em>&#8221; processing in 2007-2008 of the mining project located in Las Crucitas, in the Northern Zone of Costa Rica: as will be recalled, this mining project was declared &#8220;<em>of national convenience<\/em>&#8221; in an unconsulted and surprising manner by the Costa Rican Executive Branch on Friday, October 17, 2008, and &#8230; was declared totally illegal by the Costa Rican justice in November 2010. We refer our esteemed readers to the <strong><a href=\"https:\/\/es.wikisource.org\/wiki\/Sentencia_del_caso_por_la_mina_Crucitas\">complete judgment<\/a><\/strong> of the Contentious Administrative Court of November 24, 2010, which reads (point XL) that:<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>En relaci\u00f3n con este punto, es necesario indicar que en el presente caso ocurre algo excepcional y es que las distintas ilegalidades detectadas y las nulidades declaradas, son todas coincidentes en el sentido de que tend\u00edan a la aprobaci\u00f3n del proyecto minero Crucitas y varias de ellas se dictaron estando vigente un decreto ejecutivo de moratoria de la miner\u00eda met\u00e1lica de oro a cielo abierto, todo lo cual hace viable pensar como posible una eventual concurrencia u orquestaci\u00f3n de voluntades para llevar adelante, de cualquier manera, este proyecto minero<\/em>.<\/p>\n<\/blockquote>\n\n<h3 class=\"wp-block-heading has-white-color has-text-color has-link-color wp-elements-7c73fec409a405a7a6acbf279721d330\">Mining contract law Panama<\/h3>\n\n<p>This first decision was later ratified in its entirety by the First Chamber of the Supreme Court of Justice of Costa Rica on November 30, 2011, when it rejected the battery of arguments presented by the Canadian mining company (see <a href=\"https:\/\/nexuspj.poder-judicial.go.cr\/document\/sen-1-0034-529626\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>full text<\/strong><\/a> of judgment 1469-2011 of the First Chamber, which is of great interest to read). <\/p>\n\n<p>It is noteworthy that the reversal of the burden of proof in environmental matters alleged by the appellant in its appeal and rejected by the First Chamber (paragraphs XIX and XX of the judgment of the First Chamber) denotes the ignorance of this principle &#8211; something basic &#8211; and its legal reality in Costa Rica; an ignorance that extended to some members of the Constitutional Chamber, when they analyzed in 2020 the scope of the provisions of the Escaz\u00fa Agreement, in particular a judge who was a member of the Costa Rican Constitutional Chamber until 2021.<\/p>\n\n<h3 class=\"wp-block-heading\">In conclusion<\/h3>\n\n<p>With this decision of its magistrates, Panama offers Latin America and the world in general, a new and exemplary struggle, undertaken by various social sectors, outraged by the peculiar treatment given by its highest political authorities to a foreign company. Despite the peaceful nature of the social protests, four people lost their lives during the various street demonstrations (see <a href=\"https:\/\/www.laestrella.com.pa\/nacional\/231108\/cuatro-fallecidos-han-dejado-protestas\"><strong>article<\/strong><\/a> in La Estrella of 8\/11\/2023). <\/p>\n\n<p>This decision by the Panamanian judiciary also confirms the independence of the Panamanian judiciary, which in other parts of the continent is often seriously questioned when it comes to mega-projects of a certain size involving foreign investors: in Costa Rica, to the real company-authorities &#8220;<em>conspiracy<\/em>&#8221; denounced during a hearing in 2009 in the Constitutional Chamber in relation to the Infinito Gold mining project (see the headline of this <a href=\"https:\/\/historico.semanariouniversidad.com\/pais\/critican-contubernio-de-gobierno-y-empresa-para-defender-mina-en-crucitas\/\"><strong>article<\/strong><\/a> in the Semanario Universidad of November 18, 2009), were added other strange attitudes of its constitutional magistrates, reviewed in the documentary &#8220;<em>El Oro de los Tontos<\/em>&#8221; (Fool&#8217;s Gold) (see <a href=\"https:\/\/www.youtube.com\/watch?v=gKVS1wvvEU8\"><strong>link<\/strong><\/a>), and which we allowed ourselves to mention in November 2011 in an article entitled &#8220;<em>De cruces, cruzadas y Crucitas<\/em>&#8221; (Of crosses, crusade and Crucitas) (see <a href=\"http:\/\/www.nacion.com\/opinion\/foros\/de-cruces-cruzadas-y-crucitas\/7H3HEPDSJRG6JGNXRXJXEDL2EE\/story\/\"><strong>text<\/strong><\/a> published in <em>La Naci\u00f3n<\/em>). <\/p>\n\n<h3 class=\"wp-block-heading has-white-color has-text-color has-link-color wp-elements-7c73fec409a405a7a6acbf279721d330\">Mining contract law Panama<\/h3>\n\n<p>In the specific case of Central America, the attitude of the Panamanian political authorities is reminiscent of what has been observed in many environmental scandals arising from contracts with Canadian mining companies: three days after this ruling was handed down, the Panamanian Minister of Trade and Industry resigned (see DW <strong><a href=\"https:\/\/www.dw.com\/es\/renuncia-ministro-que-negoci%C3%B3-el-contrato-minero-en-panam%C3%A1\/a-67601476\">article<\/a><\/strong>).<\/p>\n\n<p>As part of the Canadian company&#8217;s strategy (reminiscent of that of another Canadian company in Costa Rica in 2010), the company announced, a few days before the Panamanian court decision was announced, its intention to sue Panama before the International Centre for Settlement of Disputes between Foreign Investors and States (better known as ICSID in English): see the <a href=\"https:\/\/mici.gob.pa\/2023\/11\/26\/comunicado-9\/\"><strong>text<\/strong><\/a> of the official communiqu\u00e9 of the Panamanian trade authorities dated November 26.<\/p>\n\n<p><strong>Text shared by Nicol\u00e1s Boeglin, Professor of International Public Law, School of Law, University of Costa Rica (UCR).
