Data Use Notice
For purposes of this Agreement, “Service” refers to the Company’s service that can be accessed through our website at https://sensorialsunsets.com. The terms “we,” “us,” “us,” and “our” refer to the Company. “You” refers to you, as a user of the Service.
These guidelines may change periodically without notice, so we suggest you review the updates executed to the program and note the implementation deadline stipulated in point xiii.
ii. INFORMATION WE COLLECT
We may collect both “Non-Personal Information” and “Personal Information” about you. “Non-Personal Information” includes information that cannot be used to identify you personally, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit, and preferences that are generated based on the data you submit and the number of clicks. Personal information” includes information that can be used to personally identify you, such as your name, address and email address.
In addition, we may also track information provided to us by your browser or when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you linked to the Service, the time and date of access, and other information that does not personally identify you. We use this information for, among other things, the operation of the Service, to maintain the quality of the Service, to provide general statistics about the use of the Service, and for other business purposes. We track this information using cookies or small text files that include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and stored on the user’s computer hard drive. Sending a cookie to a user’s browser allows us to collect non-personal information about that user and to keep track of the user’s preferences when using our services, both on an individual and aggregated basis. The Company may use both persistent and session cookies; persistent cookies remain on your computer after you log off and until you delete them, while session cookies expire when you close your browser. Persistent cookies can be deleted by following the instructions in your Internet browser’s help file. If you choose to disable cookies, some areas of the Service may not function properly.
iii. HOW WE USE AND SHARE INFORMATION
In general, we do not sell, trade, rent or share your personal information with third parties without your consent. We may share your personal information with vendors and other third party providers who perform services for the Company. In general, the vendors and third-party providers we use will only collect, use and disclose your information to the extent necessary to enable them to perform the services they provide to the Company. For example, when you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, you agree that we may collect and use such personal information for that specific purpose, including by transmitting such information to our suppliers (and their service providers) who perform these services for the Company.
However, certain third party service providers, such as payment processors, have their own privacy policies regarding the information we must provide to them in order to use their services. For these third-party service providers, we recommend that you read their privacy policies so that you can understand how those providers will handle your personal information.
The company safeguards and protects your personal information with high levels of security and respects your choices about how your personal information is handled. However, the company is not responsible for the misuse of the user’s passwords and access codes, so the user must put in place a security system of its own to safeguard the use and custody of such tools.
iv. HOW WE PROTECT INFORMATION
We implement reasonable precautions and follow industry best practices to protect your Personal Information and to ensure that such Personal Information is not accessed, disclosed, altered or destroyed. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by failure to comply with such precautions. By using our Service, you acknowledge that you understand and agree to assume these risks.
v. AGE OF CONSENT AND SCOPE OF SERVICE:
By using the Service, you represent that you are at least 18 years of age. The company is not responsible if there is a delay in the exchange of information, if the service is slow or if there is a storage failure. You are responsible for obtaining the necessary equipment to connect to our systems. In case of connection problems with the server, please contact: firstname.lastname@example.org.
vi. OBLIGATION TO MAKE PROPER USE OF THE BLOG:
The User agrees to use the blog respecting the law, good customs, and public order of the Republic of Costa Rica:
b. It is forbidden to transmit or send through the blog any illicit or illegal content, computer viruses or messages in general that affect or violate the rights of the owner or third parties.
c. Damaging the image or prestige of the company or third parties.
d. Copy, reproduce, disseminate, distribute, transform or modify the blog, unless authorized by the company or it is legally permitted.
f. Misuse the information obtained through the blog to send advertising, discredit the company or in any way affect its public image or any other commercial purpose.
g. Sending unsolicited messages addressed to a plurality of people regardless of their purpose.
vii. INTELLECTUAL PROPERTY
The company owns the copyright and intellectual and/or industrial property rights of the textual and graphic content of this blog (it does not grant any license or authorization of use of any kind on its rights unless otherwise agreed), which is protected by the Law of Costa Rica and other international laws on the subject. Therefore:
a. It is forbidden to copy, transcribe, transmit, retransmit, store, alter or reproduce by any electronic or non-electronic means, known or to be known, the content of the blog, without authorization from the company.
b. It is forbidden to reproduce the name, designs, trademarks, logos, or any other distinctive sign of the company in sites and portals not controlled by it, without its prior and express authorization.
c. The sale, distribution, reproduction, modification, derivation, public exhibition of the information contained in the company’s blog for profit or commercial purposes is prohibited.
The acceptance of the use of this document does not grant, in any case, an authorization of use or license on the information contained in the blog.
viii. DUTY OF INFORMATION
It is the duty of the company to report any violation of the legal prescriptions in force or the commission of any other illicit act that damages the interests of the company or the Republic of Costa Rica in order to proceed to file the corresponding complaints before the administrative or judicial authorities, providing the necessary certified proof, so that the pertinent measures may be imposed.
a. Information that in any way violates the fundamental human rights and public liberties constitutionally recognized in Costa Rica, the national and international treaties to which it is a party and the rest of the national legal system.
b. Information that induces the commission of criminal, discriminatory, terrorist, denigrating, defamatory, coercive, offensive, violent or in general, contrary to the law, morality and generally accepted good customs or public order in the Republic of Costa Rica.
c. Information that encourages discriminatory acts, postures, movements, manifestations, attitudes or ideas based on sex, ideology, ethnicity, religion, sexual preference, beliefs, age or social condition. The company declares its respect for tolerance and diversity, and promotes a policy of protection of human rights and public order, so it will not take part in any ideology or acts that evidence such attitudes, for which the user will respect such impartiality.
d. Information that incorporates, makes available or allows access to products, elements, messages and/or services that are criminal, violent, pornographic, degrading or in general, contrary to the law, morality and generally accepted good customs or public order; that damage the image of the company or third parties.
e. Information that violates the business secrets, accounting information of third parties and of any other similar nature.

We will send you Service-related announcements as necessary. For example, if our Service is temporarily suspended for maintenance, or a new enhancement is released, which will affect the way you use our Service, we may send you an email. Generally, you may not opt out of receiving these communications, which are not promotional in nature. Based on the personal information you provide to us, we may communicate with you in response to your inquiries to provide the services you request and to administer your account. We will communicate with you by email or telephone, in accordance with your wishes. We may also use your personal information to send you updates and other promotional communications. If you no longer wish to receive such email updates, you may opt out of receiving them by following the instructions included in each update or communication.
